1. Acceptance of Terms

By accessing or using Sinking Fund (“the Platform”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Platform.

2. Description of Service

Sinking Fund is a web-based fund management platform that allows users to create communal savings funds, track member contributions, manage loans with configurable interest rates, and distribute interest earnings. The Platform is designed for use by community organizations, cooperatives, and informal savings groups primarily in the Philippines.

3. User Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately of any unauthorized access to your account.
• One person may not maintain more than one active account.

4. User Responsibilities

• Fund Managers are responsible for accurately configuring fund parameters including contribution amounts, penalty rules, and interest rates.
• Members are responsible for submitting timely contributions and providing authentic evidence of payment.
• All users must comply with applicable Philippine laws and regulations regarding financial pooling and lending activities.
• Users must not submit fraudulent evidence or misrepresent financial transactions.

5. Financial Disclaimer

Sinking Fund is a record-keeping and management tool. It does not hold, transfer, or custody any funds. All financial transactions between members occur outside the Platform. We are not a bank, lending institution, or financial advisor.

The Platform provides forecasts and calculations (including best-case and realistic projections) for informational purposes only. These do not constitute financial advice. Actual outcomes may differ from projections.

Users acknowledge that participation in communal funds and lending activities carries inherent financial risk. Sinking Fund Finance is not liable for any financial losses incurred through the use of the Platform.

6. Loan Management

The Platform facilitates loan tracking between fund members and approved non-member borrowers. Interest rates, loan terms, and repayment schedules are configured by fund managers. The Platform calculates and tracks these values but does not enforce collections or guarantee repayment.

7. Penalties

Penalty calculations are automated based on fund manager configuration. Fund managers are responsible for ensuring that penalty rules comply with any applicable regulations and are communicated clearly to members.

8. Intellectual Property

All content, features, and functionality of the Platform are owned by Sinking Fund and are protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Platform without prior written consent.

9. Prohibited Conduct

• Using the Platform for money laundering or illegal activities.
• Submitting false or misleading information.
• Attempting to gain unauthorized access to other accounts.
• Interfering with the operation or security of the Platform.
• Using automated tools to scrape or extract data from the Platform.

10. Limitation of Liability

To the maximum extent permitted by Philippine law, Sinking Fund Finance and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to financial losses, data loss, or service interruptions.

11. Service Availability

We strive to maintain continuous availability but do not guarantee uninterrupted service. We may temporarily suspend the Platform for maintenance, updates, or security reasons without prior notice.

12. Modifications to Terms

We reserve the right to update these Terms of Service at any time. Material changes will be communicated via email or through an in-app notification. Continued use of the Platform after changes constitutes acceptance of the updated terms.

13. Termination

We may suspend or terminate your access to the Platform if you violate these terms or engage in conduct that we determine is harmful to the Platform or other users.

14. Governing Law

These Terms of Service are governed by the laws of the Republic of the Philippines. Any disputes arising from the use of the Platform shall be resolved in the courts of competent jurisdiction in the Philippines.
